Terms and conditions

All products are supplied subject to availability. Teddies galore and friends aim to keep all advertised products in stock, but occasionally items may be unavailable due to (but not limited to) supply problems.

Teddiesgaloreandfriends aim to dispatch orders within one working day and deliver within 3 – 5 working days, however, this timescale may increase during busy periods. Orders will normally be delivered via Royal Mail or courier depending on the size and value of your order. Teddiesgaloreandfriends will not be held liable for failure or delay to deliver your order within the estimated timescale.

UK Standard Delivery (3-5 Working Days) is FREE on all orders of £40 and over. For orders less than £40, we charge £2.50 for standard UK delivery. (Please note that UK standard delivery includes all UK postcode addresses with the exception of The Channel Islands and Ireland.)

Returns and Refunds

We understand that from time to time you may wish to return a product to us. We have created a 30-day returns policy to enable you to return products to us in appropriate circumstances. This policy does not affect any statutory rights you may have (such consumer rights under the Consumer Protection (Distance Selling) Regulations 2000).

Returns

Where you have no other legal right to return a product and receive a refund or exchange, then you will nonetheless be entitled to return a product to us where:

1. A) We receive the returned product within 30 days following the date of purchase of the product
2. B) The returned product is unused, in its original unopened packaging and otherwise in a condition enabling us to sell the product as new
3. C) You comply with the returns procedure set out below, and
4. D) None of the exclusions set out below apply.

Returns Procedure:

In order to take advantage of your rights under this returns policy, you must:

Ensure all returns reach us within 30 days from initial despatch date. Items received after 30 days will not be accepted for return. We cannot refund postage and packing charges and the cost of returning the goods shall be paid for by the customer. The customer shall be responsible for ensuring the return of the goods and we cannot be held responsible for items lost in transit.

Products returned under this policy must be sent by recorded delivery to Teddiesgaloreandfriends  6 Norlington Road, London, E114BG.

We will send you a refund for the full price of any product properly returned by you in accordance with the terms of this returns policy including the original delivery charges and excluding the cost of returning the product to us. We will refund any monies using the same method originally used by you to pay for your purchase. We will process the refund due to you as soon as possible and, in any event, within 30 days of the day we received your returned product.

Improper Returns

Where you return a product in contravention of this policy and where you do not have any other legal right to return the product:

1. A) We will not refund or exchange the product;
2. B) We may retain the returned product until you pay to us such additional amount as we may charge for re-delivery of the returned product
3. C) If we do not receive payment of such additional amount within 14 days of issuing a request for payment, we may destroy or otherwise dispose of the returned products in our sole discretion without any liability to you.

Delivery Outside the UK

Unfortunately, we do not deliver outside of the UK.

Whilst Teddiesgaloreandfriends makes every effort to describe the content and appearance of all products, due to space restrictions, it may not be able to include all details and it, therefore, strongly recommends that you read and understand the instructions and labels of each product before use, taking care to understand risks and warnings.

Colours

Whilst every effort has been made to faithfully show colour references, we cannot guarantee 100% accuracy due to differences in computer screens and devices. Please use colour references as a guide only.

Method of Payment

Our site is SSL approved and no credit card details are stored on this website. We accept most credit cards including Visa, Mastercard, Maestro and Solo.

If we are unable to supply you with a product, a full refund will be granted.

Risk and Title

Risk and ownership of products shall pass to you on delivery.

Liability

Teddiesgaloreandfriends.co.uk warrants that (subject to the other provisions of these conditions) upon delivery products shall be of satisfactory quality and fit for purpose within the meaning of the Sale of Goods Act 1979.

If any of the products do not conform to the warranty Teddiesgaloreandfriends.co.uk shall, at its option, replace such products (or the defective part) or refund the price of such products.

If Teddiesgaloreandfriends complies with the condition ‘ your right to cancel the Contract ‘ it shall have no further liability for a breach of the warranty in respect of such products.

Nothing in these conditions excludes or limits the liability of Teddiesgaloreandfriends (a) for death or personal injury caused by Teddiesgaloreandfriends negligence; or

(b) for any matter which it would be illegal for Teddiesgaloreandfriends.to exclude or attempt to exclude its liability; or

(c) for fraud or fraudulent misrepresentation.

Subject to Condition above

(a) Teddiesgaloreandfriends.co.uk total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of any contract between us shall be limited to the contract price of that contract; and

(b) Teddiesgaloreandfriends.co.uk shall not be liable to you for any pure economic loss, loss of profit, loss of business, depletion of goodwill or otherwise, in each case whether direct, indirect or consequential, or any claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with any contract between us.

Your right to cancel the Contract

If you are a consumer (i.e. a private individual who is not purchasing products from Teddiesgaloreandfriends    in the course of business) you have certain rights to cancel the contract to purchase products from us and, if you cancel, Teddiesgaloreandfriends.co.uk will reimburse to you the price you paid. In order to exercise this right, you must notify Teddiesgaloreandfriends.co.uk in writing (including email) no later than the eighth working day following receipt of the products that you are cancelling the contract. It is a term of your contract with Teddiesgaloreandfriends.co.uk that, in the event of such cancellation, you will promptly return the products to us in an unused condition and you will be responsible for the cost of such return.

Force Majeure

Teddiesgaloreandfriends.co.uk reserves the right to defer the date of delivery or to cancel the contract or reduce the volume of the products ordered by you (without liability to you) if it is prevented from or delayed in the carrying on of its business due to circumstances beyond its reasonable control including, without limitation acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labour disputes (whether or not relating to either party’s workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials.
